Real Estate Advisories and Disclosures for Home Buying in CA, Kodak Video Challenge

When it comes to home buying or home selling it's crucial you have a good understanding of not only the process, but also the requirements and standards of practice when it comes to real estate disclosures.

Yet another item we commonly use by practice (not statue, not yet) however yet required and mandatory by many offices is the STATEWIDE BUYER SELLER ADVISORY(SBSA). This is a 10-page Advisory for both the buyer and the seller in the real estate transaction.

Included on page one, each with bulleted points:

  • BUYER RIGHTS AND DUTIES:
  • SELLER RIGHTS AND DUTIES:
  • BROKER RIGHTS AND DUTIES:

It's also important to note this advisory does not replace locally required discloures, it's to help make parties aware of the roles and duties of each in the transaction. 

I'm a firm believer in providing as much advance information possible when it comes to home buying and homes selling, that's why I provide dislosures/advisories in advance when possible. Having the knowledge and understanding in advance can hopefully make the home buying process a litttle less overwhelming for consumers.

Lynda, I thought we had a lot of disclosures but I think you might have us beat.  We do live in the age of disclosure.  The more the buyer/seller know the less problems that might occur.

Hi Marchel~ You're probably right, CA has so many of them at times I think it can be even more confusing. All the more reason to provide them when possible in advance. Sort of in bite-size pieces.

Karen You're right, disclosures are a big deal here, it's about (imho) consumers making informed decisions.

Lynda--I don't think they should have allowed you to compete in the video challenge---your experience is such an unfair advantage!!  JK---but when are you going to start posting tutorials.  Please start with which camera to buy. :-)

Hey Pat, tnx but I'm learning like everyone else as we go. As for tutuorials on hardware or software I'm hardly the expert.

However...I did buy my second "flip-type" it's the zi8 by Kodak because it has a place for an external mic that the basic flip does not. I like them and use them both for different reasons. The zi8 has already been replaced with another at this point.

I found a little mic I ordered online for $25 and it has helped. I'm also learning to use the software suggested by Frank Garay (sp?) of the Think Big Work Small guys, he did a demo at an event I attended in Dallas in Dec.

So, we're all a work in progress at this point, thanks for the visit!

Lynda, we don't have state mandated seller disclosures here, but I think we are headed in that direction.  We do however have a Brokers disclosure form.  I agree with you about getting this out to all parties and like the way California has lumped it into one nice neat "booklet"!

Hi Nick ~ Tnx for the comment, and I'm somewhat suprised about the lack of disclsoures in some states but I'd guess it's only a matter of time. Here, at times I really think they can be over-done with so many of them. That's another reason I like to provide them ahead of time.

Oh btw, the 10 pager I was referring to is just one of the many pages of disclosures.

Hi Lynda - I enjoyed your presentation - Well done! (I hope you win the camera!)

 There are so many papers to sign for participants in the real estate business.  I tell my loan applicants, "Just wait until the final loan docs come in, the stack is 3 times as thick as the application! Start exercising your fingers!"  And that's just for the loan!  They've already been through the paper mill just getting the home under contract.   But, I have found, personally, that if I just slow down and read the documents there is some really good information in there.  Way too much redundancy, but some great nuggets.
