Don't Assume The Seller Dislikes Their Expired REALTOR! Basic REALTOR ETHICS

Friday I had an interesting conversation with one of our listing machines...a blogpost provoking conversation, one that would make me question some REALTOR'S ethics...not the listing machine personally but those who sometimes go after Expireds.....one of them being the listing machine's expired listing.


Often times listing machines have a defense mechanism...it's called thick skin.

They are accustomed to it...word gets out...word gets back to them.

Now with thick skin there is an understanding...if you do your job well and are successful sometimes you make enemies. 

Bad mouthing a seller's EXPIRED REALTOR because you wanted that listing...can be a huge mistake!

Recently several REALTORS have gone to the the seller's house to try an obtain the listing. 

Funny thing...our listing machine and the current seller knew the listing had expired. 

Now when you are a listing machine...often times you have loyalty...you have respect...and then it happens... you befriend the seller.

Now the seller and the listing machine have history..again when you work with someone a few times...it seems there is a certain level of trust, respect and loyalty. 

While they were going over all the new doc's and doing what needed to be done to re-list the property...the seller let listing machine know what his fellow REALTOR has said....

They weren't very kind words...and the machine is strong....they can take it...... but I felt bad.... because I know...and regardless of the strength of your skin...sometimes it gets to you... you can only take so much as you work hard to keep your reputati ons...

 

Then you explode and can't take anymore finally you feel you have no other choice but to report a  CODE of ETHICS violation.

Funny thing about the listing machine...they were not bothered on the surface...

Then again they were...after all they wanted to talk about it!

The machines face a little different..not the usual cat that ate the canary grin!  

The sad part is it wasn't just one violator...its wasn't just two REALTORS...holy smoke...

The Machine has their very own hate club!  

Be careful when bad mouthing another REALTOR..at some point that Listing Machine explodes..

It could be on you...it won't be conversation...it won't be a screaming match...instead...

A nicely folded piece of paper handed to you by your mailman. 

Be careful...

Those false or misleading statements could be a  CODE OF ETHICS violation! 

 

Article 15

Realtors ® shall not knowingly or recklessly make false or misleading statements about competitors, their businesses, or their business practices. (Amended 1/92)

• Standard of Practice 15-1

Realtors ® shall not knowingly or recklessly file false or unfounded ethics complaints. (Adopted 1/00)

• Standard of Practice 15-2

The obligation to refrain from making false or misleading statements about competitors’ businesses and competitors’ business practices includes the duty to not knowingly or recklessly repeat, retransmit, or republish false or misleading statements made by others. This duty applies whether false or misleading statements are repeated in person, in writing, by technological means (e.g., the Internet), or by any other means. (Adopted 1/07)

Excellent post! And we wonder why the public has such a bad impression of our profession.

When you're the agent getting the expired listing, it's sometimes hard to keep a straight face when the seller unloads their litany of complaints, especially when they're valid. All I keep saying is "I'm so sorry" then try to get them back to the task at hand.

Dwayne-you are right but we can change that!  Definitely what goes around comes around...I can't agree with you and one of the many motto's I live by....I don't have to do anything...it will unfold..because it always does. I think sometimes we understand estimate the consumer!  Believe me, they have enough drama already!

I work expireds hard, but I never, and mean NEVER bad-mouth the previous listing agent. I HAVE heard however, that many others do exactly that. Even outright LIE. What a shame, as it is tough enough as it is to be taken seriously and not lumped into the "Used Car Salesman" category. What a shame.

Kim-yup...in most instances we do it to ourselves..and then we have additional questions and objections to deal with the public...I have to agree...I really do not enjoy the seller bashing their ex REALTOR BUT I do listen in most instances you can see where the relationship went wrong...usually I start with well let me explain how I work and then take it from there.

Dee-and why would anyone...I think if you are talented enough and well trained and versed you will not have to! Every profession has the good the bad and the ugly...I say focus on your own services that you can bring to the table...and let the seller make their determination!  Keep working those expireds...it seems for us it's been lucrative!

Midori, I have been bad mouthed many times to my sellers. My sellers always call me and tell me about it so we can have a good laugh together!!! They also send me all the solicitations they get. My sellers and I are very close. It doesn't bother me much but it certainly pisses off my sellers. Folks need to get business on their own merits. That truly is the only business worth having.

Why would anyone badmouth another Realtor?  But what is bad mouthing?  Is it wrong to point out the other agent did not do what it takes to sell the house?  The fact is most agents aren't doing what it takes, otherwise homes would be selling instead of sitting in inventory for two plus years.  Perhaps the Realtor who had the listing expire should have just said "No" to the listing in the first place.  Still no reason to run the agent down to the seller.

Midori - I could be the machine your referring to. I don't have too many expired, but when I do they often re-list. I have been on the receiving end of hearing about other agents calling and pestering them. I never heard that I was bad-mouthed but I am sure it happens. Oh well, me and my thick skin are always prepared to shake it off and move on. I love the message it sends back to the other agents when my clients love me enough to re-list.

Midori - This illustrates such a good point.  People will never succeed in life or business if they make it a practice to get ahead by talking poorly of others.  I hope the machine filed a grievance against the offending agents.  They certainly need to learn that their actions have consequences, and find a better way to conduct their business.

Loose lips sink ships. I try never to say anything all about any Realtor to anyone. This can be a cut throat business. I just try to take the high road. If I need to vent I wait until I get home and let it all out.!!!
