What Will the HOA Documents Reveal?

Rules & RegulationsWhen buying a property located within a Homeowners Association, there are rules you have to adhere to.  Most homeowners associations for a detached housing community are similar.

  • fencing has to be the same height & material throughout the community     (if the fencing is only 4' - no privacy fences allowed)
  • exterior paint colors must be approved by the HOA architectural committee
  • sheds must be approved by the HOA architectural committee
  •  some landscaping needs to be approved (some have rules about the percentage of grass
  •  may not be able to change your oil in the driveway
  •  may not be able to park a work vehicle with the name of your company on it

 

Condo living

 

When buying into a property that is multi-family (condo or townhome) there are a few other items you need to think about -

  •  anything that is done to the exterior of your unit that can be seen from the street needs to be approved by the HOA architectural committee (windows, security door, paint)
  •  parking restrictions
  •  pet restrictions (not only through the HOA, but the City restrictions)
  •  rental restrictions
  •  garage (assigned or deeded)
  • read the financials and minutes to know what is coming in the future
  • read the minutes to see if the Board members are talking about a possible special assessment

 

Each community will have its own rules and regulations, and a good idea to do some homework ahead of time if you have a large dog, a work panel van, or would like to rent out the unit down the road.

This is good information to share with prospective home buyers.

The restrictions on work vehicles can be an issue for many.

HOAs can be awful, however I choose to live in a community that has restrictions. Without them we often find our neighbors could be difficult to live with. I tell my clients to read through those disclosures...they are like a box of chocolates...you never know what you are going to get.

Hi Joan Cox - HOA's are not for everyone.  I have one in Florida and it is great but not in New York and I am happy with that too.

There are a lot of homes with covenants and HOAs in my area, and the rules can cover everything from signage to pets to roof materials to... well, on and on.

Many people love having rules but many don't. Good thing we have properties without rules also!

We always encourage our clients to read through the material with a fine tooth comb. With that said, because we've had experience with HOA's, we always look for the key elements in the documents - just in case.

HOA rules may eliminate many buyers.  In our area you don't get to see the rules unless you have the unit under contract

Hi Joan Cox - Great post.  There are too many buyers who do not take our advice to read through the HOA docs and ask questions. I make sure I provide all HOA  forms. This is an important area to highlight.
