Presenting Marketable Title at Closing is required from a seller under contract. At final closing a seller is required to deliver a title free from any significant defects other than those clearly stated in the contract. If significant risk of litigation exists the title is not considered marketable, the buyer cannot be forced to buy the property if risk of a lawsuit accompanies it.
