Governer Paterson Signs NYSAR Bill

debra walsh real estateOn August 31, 2010 Governor Paterson signed the "Advanced Consent to Dual Agency" bill which is New York State Associate of Realtors (NYSAR) supported.   This new law will go into effect on January 1, 2011.   It will provide consumers with agency relationship choices by allowing buyers/tenants and sellers/landlords the ability to approve dual agency prior to the start of the relationship.

This law will also amend the Real Property Law by requiring Real Estate licensees to disclose their agency relationship with clients in cooperative apartment and condominium transactions.   This law should provide members with flexibility and additional protections when working with their clients.

Debra, we have a consent for limited dual agency here and usually when you have both sides (at least our office policy) we let someone else in the office write up a counter.  In my opinion dual agency is tough.  What's the opinion of most agents in your area?

Debra, We use Intermediary here in Texas.  Everything has to be per written agreement.

Nick-A deal where an agent holds both sides is very common place here.  It is however up to the clients of course.  I have been having documents signed about dual agency for the last year or so for listings.

Marchel-When it is in writing than there can be no confusion!
