Insulting Previous Buyers and Their Agents on The MLS.... A BIG NO-NO!

On our MLS we have agent remarks that are only viewable to fellow Association members. Typically this seat is reserved for instructions, short discussion of compensation and talk of a short sale. I am seeing more and more sarcastic comments by listing agents that read something like this:

"BACK ON THE MARKET, PREVIOUS BUYER SUFFERED FROM BUYERS REMORSE & GOT COLD FEET"

"PREVIOUS BUYERS LOAN CRUMBLED - LOST HIS JOB.... SELLER FRUSTRATED"

"PREVIOUS BUYER GOT WISHY WASHY AND FLAKED OUT"


If that isn't bad enough, I'm starting to notice some of the same language under PUBLIC REMARKS! None of this helps a seller.... not one word. In fact, it paints an ugly picture, spreads a negative vibe and shows that  the Listing Agent is frustrated and short tempered.

In my opinion it demonstrates reprisal. It says.... I'm going to let everyone know that you crawfished/backed out or cheesed out of the transaction! Crawfish creep backwards when threatened. ;)

Association members have access to the MLS archive report which shows the names/offices/emails and phone numbers of the PREVIOUS buyer's agent. In short, any member can find out who "bailed on the listing previously.... and now we get a little bit of mud to go with it."


QUOTE FROM OUR MLS PUBLIC REMARKS:

"Buyer had a case of the jitters and changed his mind, seller ready to make DEAL."

I wonder what a buyer would think if he or she read the above comment after "backing out?" Is really anyones business about "jitters, shakes, fear, losing jobs?"

I know that I may have more than one buyer looking at a particular property and have had occassion to write an offer for one that for whatever reason don't work out. If I saw comments like that I could guess were about one of my buyers, you can bet that I would probably try to steer clear from that realtor's listings  . . . you just never know all the facts to make assumptive remarks.

Wow, this is crazy. I have not seen anything like this yet as I search through our mls but not to say it hasn't happened. What poor taste and extremely unprofessional.

Greg, great post.. One of the worst one's I have seen was "buyer's agent was completely incompetent deal feel through." Those kind of comments don't belong on the MLS AT ALL!! you can come on Activerain and vent about the incompetency of the other agent, the weak buyers, the stressed out seller, etc. but don't put it on the MLS... Especially in the public remarks... Though buyers are allowed the walk, if they think that it's that easy they can cause problems.

Greg -- I am astonished by what people will put out there thinking only a few eyes will see it. I don't care how protected a particular area is, whatever is out there can be copied into an email or printed and distributed.

I work with a lot of investors and always take a closer look at a properties when I see remarks like this. My investors typically go unconditional with a quick close and when I see that others backed out... I wonder if they found something bad during inspection, realzied it wasn't a good deal, etc.

Hi Greg,

Very interesting post! I agree that the agents need to be careful in how they craft their remarks.  They're probably well intentioned, and are just trying to let everyone know that it didn't fall out of escrow due to an imperfection with the property & a scary home inspection report, but they're not going about it in the right way.

Greg, we remarks, additional remarks and agent remarks.  The public can see the remarks; the public can see the additional remarks if an agent emails or prints out for the buyer a client full sheet and only the agent can see the agent remarks on the full agent sheet (although I've known agents to give their buyers the full agent sheet as well which makes no sense but that's a whole other topic).  The most common remark I've seen is:  BOM buyer couldn't perform!   Things that make you go hmmmmmm.....

Greg-we have the same capability here as well and I've seen some interesting comments.  A good reason to hire a real estate professional is to keep the emotions out of the process/negotiations but when the agent loses control of their emotions, look out.

IMHO both are over the top ways to conduct our business.

So much for trying to upgrade what the public thinks of Realtors and Professionals in  the same sentence.

I don't see how this could be representing the seller's best interest.  I haven't seen any here that blatent, but I'm sure they are there, and we're suppose to be the professionals.

Greg our MLS has a link that is the equivalent of ActiveRain's "report a concern." Your examples are prime candidates to report a concern to your Association about the language displayed to the public.  Agents are getting vicious.
