The Artist Formerly Known As Prince Goes To Battle Against The Practice Commonly Known As File-Sharing

Music celebrity Prince, who got his start in the Minneapolis music scene and who has enjoyed three decades of huge popularity with fans, used to be a huge advocate of selling music online.  Prince was a pioneer in the Internet music scene and even received a "Webby" Lifetime Achievement Award for his "visionary use of the Internet to distribute music".

But that's all changed now.  Prince has decided to get tough with file-sharers and music pirates.  Just two months ago, Prince announced plans to sue YouTube, eBay and Pirate Bay, claiming that they were encouraging people to violate copyright laws.   Reportedly, his organization has sent cease-and-desist orders to YouTube and even to a handful of unauthorized fan websites.

Other artists are reportedly following suit.  Rumor has it that many artists and celebrities are fed up with being ripped off by pirates and downloaders.

What does this mean to you?   Take a moment to do your homework before you place a YouTube or other video clip with music on your Blog.  Failing to do so could result in your receiving one of those unpleasant "cease and desist" letters in the mail.  The consequences could be expensive!

I am torn about this but I guess they need to make a living too. I have a friend whose son got busted for file sharing in college. It seems a bit greedy on the music folks part but.....

Charlie, I look at it this way.  We read lots of posts here on AR by people complaining about theft of their writing and about their efforts at copyright enforcement.  If we're going to expect anyone to respect OUR rights under copyright law, we have to do the same with other creators of intellectual property, whether it's writing, art, recorded music or video.

I think members like Lenn Harley might argue with the idea that enforcing copyright is "greedy".  Lenn has been a consistent spokesperson and advocate on Active Rain for intellectual property rights.

Martin, I don't want to rain on anyone's parade.  But you may notice I don't put any music on my blog, unless it's "public domain" or it meets whatever requirements ASCAP/BMI/AFM has put in place governing the duration of a sound clip and its use on the Internet.

I currently serve on the Board of an A.F. of M. local (local 30-73, in Minneapolis-Saint Paul). I just posted some info on ASCAP/BMI/AFM and music copyright rules to my blog.

I think it's about time. Theft is theft, whether we do it online or through other means. There should not be any difference between copyrighted materials being published in print or online, and enforcemen and penalties should be the same. I don't think it has anything to do with greed. I think its about protecting intellectual property, and not wanting your industry to be de-valued through pirating. I am sure Prince is by no means broke, and is not out to make a buck or two on this.

True, Inna..we have to enforce copyright equally.  Copyrighted music deserves the same legal protection afforded to works of literature and authored works (including blog and website content).

Most musicians are not anywhere near as wealthy as Prince.  They need protection too.  In the music business, a lot of people who can't afford to have their work ripped off are injured by piracy.

Hi Eric:  I am not very sorry for all the ripper-offers who continue to steal the work of all these artists.  Just as the folks who rip off this music off the internet expect to be paid for the work they do a their jobs, these artists deserve to be paid for the music they produce.  Stealing is stealing.  Thanks for bringing up the topic.

People are not ripping off artists.  They are using html code to form a data stream to their blogs directly from youtube.  With Karen's harsh words, it's better to write this without a name.

Doreen, I don't know Tom Walsh personally, but I've heard of him.  Purdue has a great music faculty.  I see he's an Associate Professor at Indiana University, where I attended music school.

Natalie -- Some very prominent artists are very unhappy with YouTube  Their business model is at stake.  The fact that they make this material available for download does not automatically make it legal. 

Napster went through the same thing not long ago.  Read here about the history of several lawsuits brought against Napster for copyright infringement.  

You'd have to ask the people at YouTube in order to find out why they continue to distribute code for videos which may contain copyrighted material.  My guess would be that they'd be forced to say "no comment" since the matter is currently in litigation.

I generally don't tolerate anonymous comments on my blog, but I had to address the one above.  The anonymous comment contained the statement that "people are not ripping off artists".  He (or she) made the very amusing claim that downloading copyrighted material (for non-licensed use) is only "using html code to form a data stream to their blogs directly from youtube"

This is a lot like saying that a deceased person isn't really dead, but only "metaphysically challenged".  A novel courtroom strategy, if I ever heard one.  I'd suggest you contact YouTube's attorneys and offer to contribute your suggestions regarding their defense against the upcoming lawsuit being brought by Prince. 

The author of the comment concluded by stating that he/she decided to remain anonymous because Karen Anne Stone disagrees with him.  That's not very courageous and demonstrates a lack of conviction.  If you want to hide behind anonymity and make pseudo-ignorant comments on someone's blog, I'd say you've come to the wrong place.

Steve, I imagine he wants to exercise some control over his own work, just like an author would.  It's one thing to give away copies of your own recordings for marketing purposes.  It's another to have someone else begin reproducing and circulating your recordings, without your permission.
