Chris good luck I only use Buyer Representation when I feel that the buyer will not be loyal...generally they do not want to sign something like that...hence I will not waste my time on them either!

Best of luck with the webinar. I have never used this and never had to. In the end, the Department of Real Estate here would not enforce this if the client had a legit reason to work with someone else. While it may be different where you are, the words "exclusive" and "employment agreement" appear on the top of ours. That point alone creates distrust. I've sat through classes on this before and no one could give me a really good reason that this should not scare clients. We work in a trust business and if we're giving our clients what they want and need, this is never an issue. If we don't have that connection, they are/were never "ours" to begin with and we will not close a deal with them, so this document is moot. I am a top producer.

More opinions than you want to hear about.

There is a large number of real estate salespeople who just can't stop looking at a buyer broker agreement as commission insurance.  In many states including mine (MN), the broker agreement creates obligations on the part of the representative that simply do not exist without it.

Although I use them so that I can fully represent my buyer, if the buyer decided he/she wanted to use somene else it would be fine.  There was a situation a few months ago where an agent in the Arlington, TX area tried to sue a buyer for her commission and used her Buyers Rep Agreement in court to prove she had exclusivity with them and the judge ruled in the buyer's favor.  The judge stated that the BRA was unenforceable because it was an "agreement" not a contract...this document was drawn up by the powers that be in real estate here in Texas.  So although I use it so that I no longer have a fiduciary obligation to the seller when I am with buyers...I realize there isn't much behind it except the knowledge that I am not practicing dual agency.
