This is just a quick update, you may have seen it already, but you may want to be aware of it if you have clients facing foreclosure or short sale. There are new rights which will go into effect on January 1, 2013 which are set forth in the "CALIFORNIA HOMEOWNERS BILL OF RIGHTS"
This law seeks to bring more transparency into the loss mitigiation process and seeks to help borrowers NOT have to deal with multiple contacts at the lender and loan servicer's office (which lead to inconsistent updates, lost documents, blame shifting etc.) and prevents dual tracking that has lead people down the primrose path (to loan modification hopes) and yet also down the grim reapers path (the foreclosure path) oftern dropping the borrower off at the last minute on foreclosures doorstep with no loan modification or no short sale.
Click on the link above to view the Attorney Geenral Website announcement. We are beihind them all the way and here to enforce these new rights (via foreclosure insjunctions) where the lenders and loan servicers continue down the routine path of abuse. As we have always said for the past several years, PEOPLE HAVE RIGHTS, EVEN THOSE WHO MAY BE IN DEFAULT FACING FORECLOSURE.
If you have any questions concerning the new law, or need to activate your rights in 2013, give us a call. Our firm handles predatory lending, TILA rescission, financial elder abuse, real estate fraud, lis pendens, injunctions, and we investigate loan mod scams, forensic loan audit fraud, securitized loan audit fraud, and so we are here to help "right the wrong."
YOU CAN LISTEN TO VONDRAN LEGAL HOUR WHICH WILL DISCUSS THIS HOPT TOPIC.
Good luck to all of you who are representing clients facing this difficult time.
