My friend and neighbor, Richard Weisser over in Coweta County, provides a succint answer to a common real estate question. I'm happy to be able to share his good advice with my readers.

How do I get out of a real estate contract?This question comes up quite often: “How do I get out of a real estate contract?”

And the answer is actually quite simple. And I’m not going to keep you in suspense:

Consult an attorney.

You see, this is a legal question and not a real estate question.

Real state brokers and agents are not lawyers. In most states we are prohibited from offering legal advice unless we are coincidentally practicing attorneys.

So please don’t be annoyed when I offer you the PROPER response.

In California, we have so many timeframes to adhere to during the course of the contract, there are a few outs for the buyer during the first 17 days, after that, they are going to lose their earnest money deposit.

Jean, we also have a due diligence period in which a buyer can change their mind. That is reasonable. But buyers should understand that the offer becomes a legal contract after that.
