Don't Ask, Don't Tell

As a realtor, the five words I most dread hearing from a colleague are, "Tell me about your client(s)."

Just what does the other party want to know about my client(s) and why?

I am certainly not going to disclose information that could be used to illegally discriminate against anyone I represent.  Frankly if you are fishing for information, my clients' age, ethnic background, sexual orientation, religion, political affiliation, military service record, marital status, and where they lived before is no one else's business.

UNLESS...

  • They are moving into an age-restricted community.
  • They are applying for a loan with age or status (i.e., veteran) requirements.
  • The home they would like to purchase is being offered under a special program with age or status limitations.

In these cases, the person asking for the information should make clear that the inquiry is necessary.

Instead of, "How old are your clients?," ask, "Do they meet the age requirement?"  Instead of, "Is your client a veteran?," say, "This property is being offered under a special program for veterans only; does your client qualify?"

I will happily disclose necessary information if I understand why you need it.  Just don't expect me to tell you that my client is a disabled Chicago Cubs fan with 14 grandchildren who plan to visit often.

I run into this on a regular basis with listing agents believe that they are entitled to information about the buyer's finances.

I answer that question with, "They are Pre-Approved".   Anything further may cross into Fair Housing Violations.

Well, the fact your client is a Chicago Cubs fan is reason enough to discriminate - will they ever win a World Series?  Maybe they should've let in those two guys who traveled from here in Phoenix with their goat to "break the curse".  

Seriously, the way you posed your questions are much more specific and pertinant then generic ones.  Great job, Leolinda.

I get this all the time, and usually people want to know because the property may not suit the client depending on what they are looking for.  But they need to frame their question differently.  I like your examples.
