Dual agency isn't allowed in Texas, but if the broker allows, we can do "intermediary." I have used this twice, once where parents were selling the home to their daughter and no negotiations were involved; and once when an ex-husband (on good terms with his former spouse) sold the house to the mother of his child and no negotiations were involved.

Hi Lorrie,

You've given examples of reasonable exceptions that make sense in both cases. But unfortunately, most of the time the financial incentive to double dip overrides common sense!

Colorado decided several years ago to abolish dual agency, as so many agents got in trouble.

So Joan, if your company is representing a seller, is it ok with buyers not to be represented if they are interested in one of your company's listings?
