For those of you that follow any of my blogs, I just closed a short sale on a listing that I've had for two years.
The short sale was very stressful. At one point, the seller panicked and thought the bank was going to foreclosue. Instead of calling me so that I can explain to him that due to the short sale in progress any foreclosure activity is suspended, he just sent a neighbor over to his newly vacated property to pull out all the appliances.
In order to keep the deal together, who do you think had to buy new appliances? That's right, me.
And then, after 6 months of negotiating with both IndyMac and Bank of America, they both would not budge, which left a $14,682.00 gap between the two. The buyer agreed to bring in only $10,000 of that.
Where do you think the other $4,682.00 came from? That's right. Me.
So we are closing tomorrow, and the buyer is actually in Texas, but his daughter is the one who will be living there and I did the final walk through with her. Her father sent a brother and some "friend" to do the final walk through.
Well, this "friend", tries to pass himself off as an inspector and starts turning on faucets, light switches, etc.
Everything is fine. The inspection was done months ago and the buyer was given a copy of the inspection report months ago.
Then this stupid schmuck has the balls to start making things up saying the faucet doesn't work. The faucet is just fine. Then he says the light switch doesn't work in a closet. That's because he couldn't fine the switch located behind the door.
Then Mr. Schmuck asks "so who's going to pay for this?"
Now keep in mind, Mr. Schmuck is not a licensed inspector, not a licensed plumber, in fact I'm not even sure if he has a driver's license. And he's not the seller, nor the buyer, nor an agent to any party to this transaction.
Then Mr. Schmuck whips out some God-Forsaken "form" that he printed out from what appears to be a 3rd grader's version of Microsoft Word, and wants me and the buyer's daughter to sign the "form"
At that point, I had completely had it and ripped him a new one. After informing him that I have paid $7000.00 out of my commission so that the buyer can close this transaction, do not even walk in here and look to me for anything at this point, especially anything that you are fabricating on the spur of the moment.
I told him that this is a short sale, and that whatever was going to be paid for had already been paid for.
Then I told him that if he is going to portray himself as a licensed inspector, then I'd be very careful because he is putting himself in very deep legal water.
Suffice it to say, I pretty much sent this Schmuck off with his tail between his legs. You don't walk in off the street into a real estate transaction and inject yourself into something that you are not a party to and start creating quasi-contracts and legal precidents with no legal right or authorization.
But how do I really feel?......................
