Source of Water and Disclosures

As of January 1st 2008 Realtors will be using a new buy sell contact in Colorado.

There are many changes with the new contract (Sec10,10A,10B,10C,10D,10E,10F0) but one of the most significant is the water disclosure and addendum(SWA35-8-07). The source of water must be disclosed for all residential properties. If there is a secondary source of water for something other than a residence it does not need to be disclosed.

No more will the hidden wells that people have used for years go unaccounted for if the well is the primary source of water for a residence. And if the residence has cisterns it must be disclosed and a water providers name, address, phone number and website given.

Water in the West is a very big deal. We no longer can go around using it as an unlimited resource.

Water Tip - in areas where you experience extended freezing or deep freezes disconnect hoses. Your hose may freeze and break, the faucet may freeze and interior pipes may break with ice and water backing into the house.

Whoa Dena, woulda been nice if that had been in effect when my dad bought his Alamosa property, eh?  Its just another nail in the water coffin, isn't it?  Things are getting worse faster than anyone anticipated, and we're not prepared!

I for one am interested to see how this one will work. It will be great to have the disclosure, however, with water being such an important resource in our state, the disclosure alone will not solve all of the problems. If there are properties with water involved, it is alway wise to consult a water attorney. Thanks for the good information - sorry I've been away so long! I'm spending tonight catching up on your blog!

I think the key to success on the water front is awareness. Regardless of where we are water is an issue, either because there isn't enough or because of it's quality. Maybe on rare circumstance because there is to much of it. But since it is the source of life it's best we guard it.

Glad to hear that Colorado is moving in this direction. WATER is a big deal. I like the idea of rainwater catchment systems. is that idea catching on in Colorado?

janeAnne,Now that would be in interesting topic from your end. Rainwater isn't an issue here, we have very little rain. My house is only 15 years old and doesn't have rain gutters. The very few houses I know about that do collect rain water use it to water the yard if it doesn't evaporate within a week.  Hmmmm, something to think about.

Dena -  More and more people are finding out that water might be the most important natural resource, it surpasses oil because you can use other source of energy.  Without water we would be extinct.

We had a problem with our frost freeze outdoor faucet -- the outlets at the bottom had gotten clogged and we thought a pipe had been broken because of the backup. 

 If you think water is a problem there, compare Arizona!! Have you gotten snow yet?

Hi Dena,  this is very interesting.  Living in an area that nearly stays saturated with rain (even some of our drinking water I have found is captured) I never thought about these kind of water issues.  I  think it is a great idea to disclose all of that!  I would certainly want to know.
