I received an e-mail from a property owner who wishes me to take over the marketing and advertising of the listing due to not getting it sold. He goes on to say...

 

We've since listed our lot with three different Realtors, priced it competitively, had it on craigslist constantly, and there doesn't seem to be any interest at all.  

We currently have the lot listed with _________ __________, who I am not satisfied with.  So, we are looking for options.  Our lot is #____________ at ___________________ .

Please let me know your thoughts at your earliest convenience...

Thank you for contacting me to list your property but you already have an agent...?! That being known, I am not at liberty to discuss real estate with you while under contract but if you find yourself without an agent in the future, I will be more than glad to help get your property SOLD! For now, I must pass on this amazing opportunity you just presented!

Actually if an owner contacts you while they are listed with another agent you can talk to them. It is not a violation of the COE read 16-6.

I was under the impression you COULD talk to them, if they contacted you first.....still, it is safer to not discuss while under contract to another...

Malcolm, From my standpoint, there could be room for misunderstanding and I am not willing to go there. 

Margaret, I left the door open when the listing expires.

Will, Yes, I can keep in mind for buyers looking to purchase in that area. Good idea!

Cindy, He told me he wanted to keep it on the MLS until he found a new agent...I will wait until expiration to pursue .

Carol, I would rather discuss options after the contract expires.

This happens to us a lot.  If they contact me I will have a short conversation with them.  I tell them I appreciate the call and when they expire or withdraw I will discuss a marketing strategy with them.

Well, if they are not happy with their agent, eventually they will relist with someone else. I'd definitely talk to them to see where is a problem.
