Real or Personal Property...Does It Belong to Me or You? Erie/PA
The basketball hoop attached to garage was gift from my son's grandfather who is now deceased. Can we take with us when we move?
My wife's grandmother gave us her mother's prize rose bushes as a wedding present 15 years ago. Can we dig them up before the closing?
The window treatments in master bedroom match our bedding and we plan to use them in our new home.
Who owns the attached shelving units that I paid for and installed? Well, it depends . . .
-
If you are tenant, the landlord owns the shelving units once they have been installed
- If you are business tenant who rented space for your business, the shelving units belong to you. The shelving units are called trade fixtures that must be removed on or before the last day the property is leased. The tenant is responsible for any damage caused by the removal
If the shelves were installed in residential property they become real property.
