HoopThe basketball hoop attached to garage was gift from my son's grandfather who is now deceased.  Can we take with us when we move?

My wife's grandmother gave us her mother's prize rose bushes as a wedding present 15 years ago.  Can we dig them up before the closing?

 

The window treatments in master bedroom match our bedding and we plan to use them in our new home.

 

ShelvesWho owns the attached shelving units that I paid for and installed?  Well, it depends . . .

  • If you are tenant, the landlord owns the shelving units once they have been installed
  • If you are business tenant who rented space for your business, the shelving units belong to you.  The shelving units are called trade fixtures that must be removed on or before the last day the property is leased.  The tenant is responsible for any damage caused by the removal

 

If the shelves were installed in residential property they become real property.

Fixtures are included in our purchase contracts and when listing a property we will advise sellers to remove a "fixture" they intend to take with them and if necessary repair and/or replace the item.  Taking care of these things can avoid pain later when a sales contract comes along and the buyer loves the fixture that the seller loves as well.

Sue, I agree.  Fixtures are listed in PA contracts, too.  However, often both the agent and seller skip right over the fine print.  I try to impress this point on pre-license attendees and new agents.  Nice to see you today.

So important to have that discussion with sellers prior to putting the home on the market. Deal with fixture/personal property items early to avoid disputes.

Good afternoon, Lottie.  Disputes over fixtures prevent deals from going together or cause them to fall apart.  We improve our chances of closing more transactions by discussing fixtures upfront.

And a great topic for the consumer to read as well. I always tell my sellers that if they want to keep fixtures, take ithem down and either repair the area, or replace the item.

Mary, this is always a fun subject!    Here is Denver if it is attached, but sellers want to take it with, we put it as an exclusion, or better, have it removed before showings.
