Ask an Ambassador: How do I copyright my photos

Many of you have been following my "they stole my photo" story and I've had person after person ask me how do you register your photos.  You can collect damages if your photo is registered and someone takes it.  The minimum is $750 (see damages on page 160)

As a first person you do have to create a new account at copyright.gov  Once your account is created you can register works once signed in.  The cost is really affordable.  $35.00  You can register at least 16 photos for just $35.  Maybe more, but that's the most I have ever done at one time.

The next steps are to three simple to follow steps to complete the application, pay and then upload your photos.  If want you can register multliple photos for the same fee if you upload them at the same time.  My last upload was 16 new branding photos I have taken.  

If you are going to be registering multiple photos at once then you will need to check NO in the first box on this page.

It's really as simple as that to register your works.  And trust me, it's worth it for branding photos that you use on your site and advertising.

Hi Tammy, I store my photos on three independant storage vehichles including the stroage card used to take the photo. At one time I would reuse the stroage cards, not any more. I have the original in the context of the others photos takenand I would only register if I was persuing someone that was violating my copyright.

John Dotson - I thought the point the author of this blog was  making is that you have to register if you wish to collect damages.

I agree with #27 above. Most photos are time/date stamped digitally which is your copyright validity. I have registered other things but never photos. My logo is one actually.

#30, I don't believe that is the case. I wish Lenn Harley would chime in here.

If you wish to collect more that what you would have to invoiced for taking the images, they need to be registered, preferably before the violation. Most of what I photograph is used in other publications and marketing materials for others; I figure in the cost of copyright submission in my pricing to the client. That way if the images are used without permission, I have recourse under the law. As Tammy mentioned, it is so inexpensive to register your images, it is a no-brainer to register them.

Other thing to keep in mind is that copyright law is Federal law (it is one of the few things that is actually written into the U.S. Constituation) and if you are going after someone for a copyright violation, it has to go to Federal court (local and state do not have juristiction,  )  Interesting blog on copyright is http://thecopyrightzone.com/  , written by a commercial photographer and a copyright lawyer.

Can I register my watermark, therefore making every one of my photos that I add said watermark to copywritten?

Phenomenal blog, I use Picmaker to actually put the (C) on my photos, didn't know that we can register photos at this site for $35 up to 16 at a time. I'm following you now because of this blog, please do the same for me if you like.  Again thank you for this important post.  I was going to go over this very important topic and was wondering if you'd be OK with me referencing this blog and linking to it when I do?

Tammy I've registered some of the maps I created years ago.  I was at a presentation by a developer and noticed he had one on his presentation boards.  I gave him the stink eye but since I wanted to remain on good terms with him AND he left my name with copyright on it decided not to pursue.

Thanks for this, Tammy. It is amazing how many photos are taken because people don't realize they are automatically copyrighted upon publishing. I did the same thing when I was starting out.

Christine, I will ask my attorney their advice on that in the morning, but I would say no... that it's best to register the original with no editing, ect...
