My Landlord do not fix my Mold issues

Arguments about indoor mold growth are usually the tenant claiming there is a problem and the landlord saying there isn’t. Whenever there is a dispute where it is one person’s word against another, an unbiased third party can help mitigate the issue. Once the Mold inspection is complete and samples are analyzed and the Mold Assessment report is completed there will be concrete evidence proving whether or not a Mold contamination issue exists. A Mold Assessment can offer a peaceful resolution and causes the other party to take action immediately. Either the tenant stops the claim about mold causing health issues after the Mold Assessment report is completely and conditions are not elevated, or the landlord agrees to pay for the recommended Mold remediation and repairs. Documentation is key in documenting your actions in pursue of getting you living space Mold issues resolved. We cannot offer legal advice however; there are a number of agencies that can assist you with the proper process such as County Code enforcement, Attorneys among others. Here are recommendations that can assist you in getting your Landlord to take action:

  1. Write an email to your Landlord expressing your concerns and request having a state of Florida licensed Mold Assessor to perform a Mold inspection, take indoor air quality (IAQ) samples and prepare a Mold Assessment report.
  2. If the Landlord does not comply with your request, take it upon yourself to hire INDOOR MICROBIAL SPECIALIST and perform a Mold Assessment. You may wish to send another email explaining you are doing so and mention that you plan to deduct the cost of the Mold Assessment from next month’s rent in the event a mold contamination issues are present inside the house living space.
  3. If your landlord continues to ignore the issue you now have a paper trail of communication and a Mold Assessment report that you can seek legal counsel to take action on your behalf to try to recoup all your expenses among others.

At this point in time most likely your landlord will do his best to address the issue. If not you need to find out what rights you have and go from there. Are there any state laws regarding organic microbial (mold) and inhabitable conditions pertaining to breaking a lease? Do you have the right to withhold rent? If you live in a building, are there other units experiencing similar problems? Your legal council should be able to assist you and guide to get the problem resolve positively in your favor.
