Got a call from a homeowner a few days ago. Seems he had received one of my solicitation letters that I send out daily to all expired and withdrawn listings in my market area. He was wondering why he got a letter since he had just listed his house on the market a few weeks ago. Well I got his address and phone number and told him I would look it up in the MLS and call him right back. When I checked the MLS he was currently active but had been withdrawn for one day and re-entered by the same office by a different Realtor. I called him back and gave him this information and had a nice chat with him. Very pleasant and knowledgeable young man. Wished him luck with the selling of his house and told him to feel free to call me if he ever had any questions or needed any help.

Well lo and behold he called me two days later and asked if I could come by and see him because he was thinking about changing Realtors. Sounded good to me so I made an appointment and went to see him the next day. He had a great  house! I had a look around and sat down with him and his wife to go over market conditions and give him my opinion of what his house was worth and what it would take to get it sold. He was currently listed at $215,000 with a 4% commission. My suggestion was $195,000 with a 6% commission. While talking with them I discovered a few things 1. They had never seen a Market Analysis 2. They had never sold a house before 3. The wife had been transferred and they wanted a quick sale 4. They had never heard from their Realtor since being placed on the market. I left them with all the information I had prepared for them and told them to keep me in mind if things didn’t work out with their current Realtor.

Called me the next day to let me know they had fired their Realtor and wanted me to place their home on the market with me. They said they slept great the night I left knowing there was hope and that they now had the information they needed to make a good decision. I now have a beautiful new listing with great Sellers. “Range Priced” at “Market Value” ($189,000 to $209,000) and a 6% commission so we can offer a good Co-broke. All these Sellers ever wanted from their Realtor were the facts. I have now connected them with a Realtor found through ActiveRain to help them purchase in Arkansas, for a referral fee of course. The Sellers are confident about their relocation. I am happy with my new listing that's priced right and had two showings as soon as it hit the market. And their previous Realtor…………….?

Just shows you what we have out there doing real estate.  The funny thing is that kind of Realtor is not here reading this post.  They are at the beach, playing golf, whatever.  Not that those things are not important once in awhile but so many Realtors simply are not knowledgable and committed.  Immediately, with ink still wet on their license, they thrust themselves on the poor unsuspecting public!

With the current flood of new Realtors your posting is hardly a surprise.

Most newbies price setting 'techniques' consists of asking the seller how much they want for their house and then often adding their commission on top of that.

If there was ever a guarantee for failure...................................

Bryant,

I'm sure you've considered this fact but just in case.

Did their former Realtor consent to be "fired" and give them a release from their listing??

If not you could have some potential problems down the road, i.e. when you sell the house.

Just because a listing is withdrawn in my MLS does not mean the listing is no longer valid.

Hi Jim, of course. I would never take a listing unless it was expired or withdrawn. And I would never talk negative about another Realtor. Already sold and closed. No problem. The other Realtor actually showed it a couple of times after I had taken the listing. Jim I have very little patience with Realtors that don't know the business. Sellers just want to sell and in my opinion deserve competent and honest advice when it comes to market conditions. If the Realtor makes no effort to provide this I have no problem stepping in and getting the job done.

Not implying that you would do anything unethical.

I just hear stories from sellers who tell someone they "fired" their agent, their agent withdraws the listing from the MLS and the listing contract has 2 more months to go before it expired.

You're right that sellers just want to sell and buyers just want to buy; our job is to make it happen for them.

Our Broker tells us we are not allowed to contact sellers that have their home already listed.  Even if they contact us first, we are supposed to tell them until their listing expires or the listing is cancelled, we are unable to meet with them.

I think if someone is really that unhappy and I'm able to go in there and be professional, show them what services I provide without talking negative about the other Realtor, then what's the problem?  I had to wait 3 weeks one time to take a listing because the other Realtor wouldn't cancel it in the MLS or remove her yard sign (in Alaska they are huge yard signs so they couldn't just pick it up and put it in the garage).

I was wondering how everyone else goes about getting the expired listings typically. Do you usually just mail postcards every week  for a few weeks or do you try to call them or does anyone ever go try to meet them at their house?

Isn't it against the COE to meet and solicit an active listing? I know you 'just gave them the facts', but did you need to talk to the LA at all? So... if I am getting this right... if the seller asks me to meet with them and give them a CMA of their home that is ok? I think many many agents up here would be ticked and file a complaint that I was trying to steal their listing. Is that something you have the Seller sign something on? Ha. Good Posts and topics.... only 420 some to go...

Matt not only can I meet with them but I can also have them sign a listing agreement dated for when their current agreement runs out. It is not unethical at all. What's unethical is me specifically soliciting active listings however if they make the initial contact I am free to meet with them and pitch my services. I do it all the time. In fact I'm doing it later today.
