The role of the real estate agent and broker in a Georgia real estate transaction is often misconstrued. One of the services that I offer is expert testimony regarding the actions of agents and brokers in real estate transactions that result in lawsuits. In most situations, the first call from the lawyer pretty much puts an end to the potential case. For some reason, there is a common public perception, even amongst those in the legal realm, that agents and brokers have a lot more responsibilities in a transaction than they actually do. What does a real estate agent or broker do? In the state of Georgia the answer is pretty simple. A real estate agent or broker performs the duties agreed to in writing in your brokerage agreement. ANY level of service can be negotiated. The only duties that are off the table are those demanded by Georgia Law or a Georgia Real Estate Commission regulation. When negotiating a level of service with a real estate agent or broker, here are some things to consider: Do you want representation in the sale and assistance with negotiation? I got a call yesterday that started: "I would like to check the availability of your listing at..." The only problem was, it wasn't my listing. I immediately realized that the caller had found the property on one of my IDX website and assumed it was my listing. I politely asked "Are you an agent?" The caller said "no" but that they had an agent that was helping them and that he was just checking availability for him. Now, since there was already a listing agent and a buyer's agent already involved, I simply asked the caller to please have their (80 comments)
