Sellers beware - Listing Contracts with no expiration date! - 04/18/09 04:28 PM
It has called to my attention a proliferation of selling listing contracts which they do not have a specific expiration date. This is in violating with the principles of a listing contract which has to have a specific starting date and a specific expiration date. Some unscrupulous agents are using this practice to retain the client for ever, even though if they do not perform with the client. Listing contracts without a definitive expiration date should be void and null to protect the interest of the seller. This is a critical topic and I would like to open it for discussion!

Another simple interesting tip: Please have a signed Tenant Representation agreement before starting your search and working with a Tenant. Did you know that if you do not have a tenant Representation agreement the only responsible for paying your commission is the Listing Broker? Interesting!! The first step you should take when you are going to take a business listing, it is to differentiate clearly the current owne'r discretionary earnings. Most of the time these earnings are hidden and they do adversely affect the value of the business.
If you think it is hard sometimes to deal with residential buyer representation at least you have the procuring costs built in. On the other hand in commercial real estate, procuring costs are by far more difficult to prove. I highly recommend that you enter in to an exclusive agreement to represent, I have put one together which you could use.

Measure before and after tax investment performance Understand the components and structure of commercial real estate loans ( conduit, non-recourse, etc) Use the basic cash flow model to compare diferent commercial properties
