Fred Weaver and Kevin Kauffman of Group 46:10 welcome their good friend Brian Gubernick back to talk about his experience at a class given by Bank of America’s Matt Vernon (yo Matt – where’s your FaceBook fan page?).

It seems that B of A is making advances…  And by all accounts…  Matt is a stand up guy – who knew?  Matt was honest and up-front with their short falls.  A great change from OCWEN

Watch and find out what Brian learned.

Hi Guys, As I am listening to this I am getting a stomach ache! I met Matt Vernon back on March 26th at the San Diego Association of Realtors meeting and exchanged several e-mails with him about my Heloc issues and my 7 month deceptive "trial payment" senario . I actually spoke with him directly and he told me to e-mail him and he would do what he could to help me. He does seem like a stand up guy and at least responded to me. I also admired that he took our questions head on and was a fresh guy since he had only been with B of A for 90 days at the time. But, I am back in the same place and as when I started because he didn't do anything but refer me to the head of the corporate collections department. Mind you, I had my first trust deed modified by Bank of America last Sept. the issue is with my Heloc (which is tied to a floating rate and my home here in California is $250,000 underwater). My last e-mail exchange with Matt was not a happy one regarding Bank of America and their deceptive pratices (in which he didn't e-mail me back), so I wouldn't ask to start a Matt Vernon face book fan page just yet. Oh, and one last thing.....I spoke with their loan modification department yesterday and they referred me to their foreclosure department. Mind you if the second (which is worth only a third of my first) tried to foreclose they would would be negative. Sorry to burst any bubbles on Matt Vernon, but really?....do you really feel a love fest for this guy? Who's side do you think he is on? It is not on the homeowners trying to keep their homes. Does anyone have Matt Vernon's email?  I have been desperately trying to get in touch with him.  I have a short sale issue that needs executive escalation and attention.  Basically, I have an offer to purchase (contract agreed to by sellers) on a short sale property which BoA held the loan.  A BoA negotiator was assined, BPO done, I paid for the appraisal, etc.  We were told over and over BoA was sending the final approval...never sent.  Then, last week (while the BoA negotiator) was out of town....the property was randomly pulled to be put up for auction!  So, now the negotiator is trying to have this process cancelled, but unsuccessfully so far.  In essence, BoA is putting this property up for auction for $237,000 (minimum bid) while it only appraised for $232,000.  If they do not receive an acceptable offer, then it will go to foreclosure.  HOW CAN THIS HAPPEN???!!!  BoA has royally screwed me and the sellers over...and themselves as they will end up getting less $ in the end.  Don't even get me started about how the American taxpayers are being affected.  Absolutely absurd and ridiculous.  I am so disgusted.  There is a BROKEN PROCESS here that needs to be addressed as it is happening repeatedly to people all over the country.  If I did this at my place of employment and didn't offer a resolution, I would be fired.  Seriously, someone step up and be responsible and accountable.  WHAT ARE WE PAYING FOR???!!!!

Hi Tiffany,

Thank you for the email address for Matt Vernon.  Have you had any experience with Bank Of America, where the investor is Freddie Mac on the 1st?  Bank Of America is not only coming back with a counter offer of $360,000.00 that is well above the market value  and the original promissory note was $318,000.00 and the 2nd was $50,000.00. They are also asking for a very large cash contribution from the seller.  Our Negotiator said it was a requirement from the investor.  We represent the seller and the buyers lender reequested an appraisal and the appraisal came back at $322,000.00 which is what they offered.  I would love any suggestions you might have.  I have heard that Freddie Mac has forced some sellers into Foreclosure.  They have turned around sold the home to the buyer at the offer amount and paid the buyers agent and not the sellers agent.  Please let me know if you have any ideas of how get someones attention.

Thank you so much,

Pam
