Offer Accepted -- It's Now Time To Do Some Investigating

Congratulations your offer has been accepted and the clock has begun for the purchase of your new home.    Exciting and yes, I understand a bit overwhelming.    According to the purchase agreement and the disclosures you and the seller initialed and signed, the path to your new home has taken another big step.

When you signed your purchase agreement, we reviewed two documents:

The Buyer Inspection Advisory -

this two page advisory explains the importance of a property investigation by an inspector as well as by you.  The advisory informs that the buyer, seller and the broker have certain rights and duties.  What should you review?  There are many:   the general condition of the property, sources of square footage, age, boundaries, wood destroying pests, soil stability, roof, pool/spa, waste disposal, water/utilities, earthquake, flooding, insurance, permits, zoning, governmental requirements, rental property restrictions, security and safety.  You will also want to look(take another look) at the neighborhood and the surrounding area plus any personal factors.   

 

The Statewide Buyer and Seller Advisory -

this ten page advisory seems a bit repetitive to some.  It goes into more detail than the Buyer Inspection Advisory and includes covenants, conditions and restrictions, product recall notices, supplemental tax notices, liquidated damages, arbitration, mediation --- a total of 49 points.

Feeling overwhelmed?  Please don't.   This is an exciting time and I'm here to help you along the way.  As I did when the offer was written, I am here to answer questions and to attend inspections(as many as you want in the time that was established).  This is known as the inspection/investigation contingency time.  So, it's time to get started.....

Michael, It's the contingency time that sometimes causes problems.  When the inspection is not acted on quickly and say something like a radon test or well water test takes 24-48 hours for results to be produced.  Sometime extentions are needed by rarely is anyone happy about applying for one.

Vince -- establishing and getting realistic contingency time periods approved is important upfront.  Even in the best scenarios, extensions may be needed --- hopefully with enough notice to keep things moving forward.

Michael, Time for some due diligence by the buyer and their inspectors.  No doubt a crucial part of any contract.  This stuff can make or break a contract in a heart beat. When inspections uncover a plethora of defects things really get interesting for all parties.  We need to be on our toes and handling the objections with care.

John -- exactly!  This contingency period can be very time-consuming and stressful for a buyer.  First there is the out-of-pocket expenses combined with the uncertainty of the outcome --- it's our duty to keep things on track and be mindful of the anxiety of the situation(especially with first time buyers).   Some of this can be avoided with in-depth and in-person initial meeting with the buyer(s) before a property is ever shown.  What to expect?  Are expectations reasonable.  Lots and lots of questions as well as careful listening.   Thanks for your comments as always.

Suzanne -- first, you bring up a very good point -- this post deals with the state of California and even within our state we have differences in some aspects how we practice some of the finer details.   In additon to the inspection/investigation stage, a buyer is faced with a plethora of disclosures and advisories, reports and of course obtaining a loan and appraisal.  Yes, the work has just begun but at the end, hopefully there will be a new home that is just right(or close enough) for you.

Todd - as I tell my buyer clients, it's better to know any issues upfront and to sellers --- disclose, disclose, disclose -- and when in doubt, disclose.....

I actually enjoy the inspection process, usually.  It gives me an opportunity to learn more as well.  And, you are right....disclose whether or not you believe it is a material fact.

Don -- I agree that during most inspections I learn something and I know the buyers learn(and become a bit frightened and/or overwhelmed) during the process.   You can't go wrong in the long term .... when you disclose property/neighborhood material facts.

Michael Jacobs - This is really great information to know for buyers in CA and for me as an Agent in Texas. I get prospective Buyers from CA in my Open Houses pretty regularly. A couple came in yesterday. He was from TX and his wife-to-be is from CA. Both previously married; both have homes in each state. It was interesting for me to hear them converse together in the kitchen.

I noticed, he was pretty well versed with TX Real Estate Law and she seemed to me to be exceptionally knowledgeable with CA real estate. As it turned out, she was a Mortgage Lender and even though he never said what he did for a living, I'm pretty sure buying property in TX isn't his first rodeo.

The Advisory forms are of interest to me. For example: "this two page advisory explains the importance of a property investigation by an inspector as well as by you."

The first thing  that came to my attention is it clearly states the property investigation is between the inspector and the buyer (not the real estate agent). That's good! It is that way here in TX too; however, the couple from yesterday told me they were under contract for the past 4 months and couldn't come to terms with an agreement because they said the agent here in TX kept trying to overstep her boundaries by elevating her knowledge over the inspectors. What you get when you have an educated buyer from CA and her partner who is native to TX who disagrees with the TX seller's agent? You get is a terminated contract with buyers who don't trust real estate agents! 

I'm not familiar with CA's 10 page advisory but I would like to see a similar form here in TX. We have a General Information form but this one you describe is very specific to home inspections which is critical for buyers to know. 

I feel like I am always being educated in the best way, between what I learn in the state where I do business, and how things are done in CA. Since my experience was fresh, coming in yesterday afternoon, I wanted to say thanks!

Patricia - and then there are differences in agreement interpretation/ practice from South to North CA or even in the same area.  First rodeo or not, communication is important as well as knowledge of "the paperwork ".
