You have a renter that keeps making excuses about why he is not paying and each day how he is going to pay you and then more excuses: grandmother's death, getting a tooth pulled, hold on check from the VA at the bankl and on and on.

What would you do?

1. Post a 3 day notice and begin eviction

2. be patient until you get the money and then evict him for violating the lease

3. Take the money and give him another chance to pay on time before evicting him

Hi Lori,

I would stick to the terms of the lease agreement 90% of the time.  In Georgia the eviction process is pretty quick, so I do weigh the situation in terms of length of tenancy (i.e. a long term tenant with a short term problem).

Hi Lori, I don't know the history of your tenant, so I can only say at the least I would apply pressure to shape up. Assess late fees, go over the terms of the lease with them again. If they have been a good tenant, maybe looking at a different due date for the rent.

If he is no more than a month behind , I would keep work with him . HOWEVER I would ALWAYS hit him with a LATE CHARGE !!!

It certainly would default to a month to month lease.  The late fees do become a part of the process, and if that is not paid with full rent within 30 days, then the eviction starts.
