State Rules on Home Sellers Recording Showings
Real estate agents know that they should warn prospective home buyers that the showing may be recorded by one or more video cameras in the home. Evidently, these recordings are allowed in all of the states.
However, if there is an audio recording, the rules vary from state to state. Listing agents should advise home sellers to be very careful to comply with the state regulations if they plan to make audio recordings of home showings. The following link will take you to a current article that provides a schedule of the basic state regulations.
Does Your State Allow Clients to Be Recorded?
Since real estate agents should not be offering legal advice, it may be a good idea to have an attorney prepare a written statement on the specific state laws that may apply to the recording of home showings.
