Why in the world would you tell people around you not only that you have made an offer on a house, but even worse, why would you give out the details?

Someone asked me for some real estate advice yesterday which I am normally happy to give out, especially if I think it might land me a new client.

However, it turns out that I was asked some advice that would pertain to an offer that is in conflict with one that I have in.

Luckily, I asked first which property this advice pertains to since all properties have some problems that might influence a transaction. NOT ALL PROPERTIES ARE ALIKE.

No, this was not the offeror who asked me, but an acquaintance of that person.

The minute I realized that it was a property that I had been asked to make an offer on on behalf of a client of mine, I told this "acquaintance" that I could not tell her anything. THAT THERE WAS A CONFLICT.

AND I SHUT THE CONVERSATION DOWN RIGHT THERE AND THEN FROM MY SIDE.

The problem is, I can't "unhear" information and I can't ignore it, I will have to act on it. After all, information that is "out on the street" is not confidential and I do not owe the other offeror confidentiality. I really hate to be put in that position!!!

SO TODAY I NEED TO ACT ON THAT INFORMATION.

Hella,

People just need to careful of what they say regarding making an offer on a property.  It's a small world sometimes, and you have a right and obligation to serve the interests of your client.

Just the fact that you shared your experiences, Hella M. Rothwell ... should serve as a red flag and warning to anyone involved or somehow owning information ... regarding a transaction.  Shhhhhhhh ... no sharing!  What part of that advice is hard to grasp or understand??  Kudos to you for your actions!

I really hate being placed in positions like that because it is a conflict. I especially don't like it when 2 buyers want the same house because I can't represent both, so I ask whether the other really wants to do battle against me. That generally takes care of that desire, and they decide to hire me to buy something else. Whew.

That just blew me away yesterday. Don't even want to go further into it here. Suffice it to say that I called my client to tell what happened, and to make SURE that my client is not roped into talking. It can be a small community out there!

As to clients getting "excited" about finding a house and making an offer, ZIP IT until the offer has at least been accepted and there is a valid contract!!!

Now that was awkward! I am sworn to confidentiality but I'm beginning to realize many others are not. This is a classic topic of discussion for an Ethics Class. Not long ago I was about to list a property and everything was going swell until just a few days before the listing and my seller called to say her neighbor and best friend who never had any intention to sell just put her house on the market. The two of them were talking and comparing notes. Within 24 hours the neighbors house went under contract and mine decided not to sell. We are always tested, aren't we!
