Can you keep our offer a SECRET?

I have a secret and it is so big i have to share it with you. I got a new listing and it was not long we were showing it to interested buyers. That is where i met Ms. New Buyer broker. This is her first buyer.

 

The showing went very well. Her buyers were real interested. But, so were the other 7 sets of buyers i showed that day. As the day was coming to an end, Ms. Buyer broker called and said her buyers wanted to make an offer. She said she wasn't really sure how to use the software to write it, so it may take a while. She also asked if I could keep her offer a secret. I asked why? The reply was she was taught that once other people are told that there is an offer, they too will make offers. She did not want any other offers to bet her clients offer. 

 

 

I paused to ponder this answer.  I was waiting for the second part of a joke that never came. So my response is simple. As the listing agent my job is to bring the best offer to my seller.  That means to get as many offers as i can. If Ms. Buyer broker wants her buyers offer to be chosen, she better write their highest and best offer first. Stay tuned for the outcome....

Hi Scott... in NC we are not technically obliged to reveal the existance of other offers unless our sellers tell us to do so. But in a market like we've been experiencing these past years I suggest to all buyers to put their best foot forward right away... I've seen plenty of sellers who don't call for highest and best so there's not always a chance to sweeten the offer.

Newbie hopes showing there. I always explain to my buyers that whilst I will keep their offer and it's terms confidential, once we deliver there is no guarantee the listing agent will if instructed by his seller to share the terms and see if they can get a higher offer unless you submit a non-disclosure agreement before presenting and most sellers are not going to sign it.

We are always obligated to do as our sellers instruct regarding the disclosure of another offer on the table. However, we are also required to be honest. I generally say something like this, 
"There's a suggestion of an offer coming in, but we haven't seen it yet." 

As for the other agent. I'm guessing it's her "green" is showing - as in the greeness of being new in the industry. Hopefully, she took your advice. D

Hey she's a brand new agent so I'd cut her some slack an do as you did Scott.  Help her learn just why you absolutely could not keep her offer a secret and work against the sellers best interests.  She'll learn!

my reply would have been that I only take my instructions from my sellers about offers and who to tell.

Hilarious! 1. She can't use the software, where's the broker?

2. As a listing broker, you have a responsibility to your seller, period.

This is not confined to newbies though. I had a leasing agent at a large complex tell me that I COULD NOT reveal the sale price of a unit I sold, because it undercut some of their asking prices. Uhhh . . . dude . . . it's public record.

It is the same here Nina Hollander , when listing a home, i go over with the seller any pros or cons and they decide. Nearly all sellers agree leting buyers know an offer is coming or is in, helps to get more offers. and YES, i do agree buyers need to put their best offers in quickly.

I did not want to criticize but did want to point her in the right direction Joe Pryor . Her buyer was interested and my jpb is to get more offers, not sacare offers away
