In California which is the toughest State to work probates we have two probate procedures to sell real estate out of.   The old Court Confirmation process with 10% deposits, Court Appraisal, and Over Bidding which sucks and has kept most away from Probate R/E and then the new procedure (1987 Ha New!) which allows us to treat the sale as a regular sale without court supervision, 10% deposits, appraisals that affect the price and most important court overbidding.  You just need Letters of Testamentary or Administration, The Notice of Proposed Action (N.O.P.A) and word from the estate attorney to title … (0 comments)

Many times I will enter into a signed offer with the PR who hasn't been approved yet as Executor or Administrator.   WHAT!  I know some of you who know probate may be saying "The PR can't sign the sales agreement until they are approved"   and you are correct to some degree but I'm going to take deals away from you if you go up against me on a Probate Home and you don't know this information.
