The Agent with the Sign in the Yard!

In the State of Colorado a real estate agent becomes an agent for the Seller when a contract is created between the seller and agent.

If the agent is a Seller's Agent they are required by law to fulfill certain duties:

  • Promote the interests of Seller with the utmost good faith, loyalty and fidelity;
  • Seeking a price and terms that are set forth in a Seller Listing Contract; and
  • Counseling Seller as to any material benefits or risks of a transaction that are actually known by Broker.

You, the buyer are a customer to a Seller's Agent.  That is no different than walking on a car lot or into a department store...looking for someone to help you.  (And you are spending thousands of dollars!)  

If the agent is a Transaction Broker they are an assistant to either the buyer or seller or both.  No written agreement is required!  They assist either or both parties by performing terms of any written or oral agreement...without being an agent or advocate for any of the parties...and you are spending thousands of dollars!

Now, if you are a Buyer, why in the world would you call the agent working for the Seller?  Think you are going to get a better deal?  Think again!

Would you ask the coach of your competition to coach your team too?

Would you ask the attorney for the other side to represent you too?

An Exclusive Buyer's Agent works only for you...the Buyer!

If the agent is a Buyer's Agent they are required by law to fulfill certain duties:

  • A Buyer's Agent works solely on behalf of the buyer to promote the interests of the buyer with the utmost good faith, loyalty and fidelity.
  • The agent negotiates on behalf of and acts as an advocate for the buyer.

Tell me again why you would call the agent with the sign in the yard!
