Is a CONTINGENCY STILL a CONTINGENCY even if it is really SMALL?

BUT the contingency is a small one, WHY did my offer get rejected? Mrs. Buyer Broker A CONTINGENCY is STILL a CONTINGENCY no matter how SMALL. As a leading Listing Agent of Bank Owned Homes here in the manchester NH area this week I got 2 new Listings that generated near 30 offers between the 2.

 

With BANK OWNED HOMES the conditions for submitting an offer are strict. With these homes they were "cash only" purchase as they needed too much work to pass an inspection or for a buyer to be able to be guartanteed a loan to purchase it.

When you get a high double digit amount of offers the offer price is important but not the main factor for the Bank choosing and accepting an offer. An offer that is lower in price with NO contingencies is stronger than a higher priced offer with contingencies.

In one case the buyers offer was slightly higher but the agent decided they would make it contingent upon reviewing and accepting the deed and the availibility of property insurance for the property all within 12 days. Because it is common to check these boxes with owner occupied sales they checked them. Because of this the offer was no longer no contingencies but to what she said "were only small ones the buyer did not really care about". They were still contingencies that could halt the sale.

The moral of the story is that whether you are a Buyer or a Seller, you have a choice in agents. You have to choose one that is full time, full service and is well experienced in not only the area you are buying in but the type of home. All agents are not experienced in buying or selling Bank Owned Homes. Choose one that is.

NO contingencies means exactly that, DO NOT place any contingencies on your offer no matter how small. In these cases it caused rejections.

I'm still trying to figure out with what you wrote if you DELIBERATELY did this poor spelling or not. Oh well, enough people have let you know Scott. As a seller avoid ALL contingencies if at all possible. They only HELP the buyer.

Good point. Contingencies shift risk back on to the seller and that causes problems no mater how small.  A contingency that the sun will come up tomorrow is still worse than an offer without that contingency.

And while we're at it, I like to see offers professionally written without spelling and grammatical errors . . . but that's just me. 

Contingencies are a hot button issue. A good buyer's agent should NEVER advise their buyer-client to remove contingencies that are truly material to the buyer.

However, the issue is moot if there is no way, no how that the buyer's offer will see the seller's signature. ESPECIALLY when that seller is a bank.

It's a reminder that we all risk in real estate transactions. So if you want the house, make that offer clean and neat.

Yes, I mean the buyer too! ;)

It's amazing how people will try to "skirt" the rules thinking that they are above someone else telling them what to do.  I'd reject completely and loudly someone who put in an offer that was contingent upon.....when they were told specifically not to do that.

JUST A NOTE the Header and beginning of my post was taken from the email I received that contained the word contingency spelled CONTINGINCY. I may have needed to disclose the sarcasim as when wrting my blog I tried to stay with her spelling and quote some other words that were spelled as if someone was using phonics such a sa-mall for small. I only posted the first statement to save you from reading the rest. SO thank you to those who emailed privately who were really concerned and thank you to some others who said I needed spelling lessons with some overly sarcastic comments.

Sometimes an agent thinks that a contingency or two are necessary to protect the buyer – the client. Sometimes a contingency cost the buyer an opportunity to buy a house. Your post is an example of the latter…and an agent who, perhaps, has learned a lesson in a competitive market.

Scott:

Buyers and their agents should carefully read the remarks in the MLS and comply with those remarks.  If they need a contingency, then they should not make an offer on the home.  The lender will turn down their offer because it does not meet the lenders requirements.

Most all of the REO properties DO NOT want any conditions, and in a market like ours, with low inventory and multiple offers, a contingency is going to cause the offer to be passed on.
