How do you feel about Buyer's Agents rebating a portion of their commission to the Buyer? My immediate answer is that I could not care less. I'm mainly a listing side Broker and it does not affect me at all. But then I started thinking about it and came up with a few questions:
How is a Buyer's rebate handled without it becoming mortgage fraud? What do you do if the rebate is not allowed by the Lender? When and how do you disclose this rebate? Is this rebate credited on the HUD-1 statement at closing or do you … (48 comments)

Here's an interesting dilemma for you. Let me know how you would handle it. I have an appointment with one of my long time customers tomorrow to write a deal on a new construction townhouse. This particular buyer is the daughter of one of my investors. Over the last couple of years I have assisted this investor in the selling and buying of about 10 properties, including a couple of duplexes he is in the process of purchasing right now where my investor is paying my $6,000 fee.

I wrote a post back in November related to buyer rebates. My question then and now is the same. "Are Buyer rebates, not disclosed on the HUD, legal?" Anyway, over the last few days my previous post has come back to life. We have been having a pretty good debate but still I have not been able to get my head around my initial question, "Are Buyer rebates, not disclosed on the HUD, legal?"

Ok, so today I have had an awakening. Over the last couple of weeks I have been negotiating, successfully, with a couple of REALTORS® from one of the "Buyer Rebate" companies in my area, and I have to say, I have been impressed. Both REALTORS® have been on the ball and have done an excellent job of communicating and getting the deals pending. This has given me a new found attitude towards "discounters".
