I saw something the other day that I had never seen before. Two small flys, were fighting with each other. I am no expert here, but I will comment best I can....They did their battle in a circular fighting format. Round and round in complete tight circles spinning in mid-air....then they stop. Then, suspended in mid-air...they either went up or down, left or right and then started the circular chase and attack on each other again.

I have a client who is in the middle of a short sale. All ducks are lined up and the bank is cooperating. It can close in 2 weeks time. I get a settlement letter from Chase with the following clause in it. This is the first time I have come across this....
"The amount paid to Chase is for the release of Chase's security interest only and the borrower is still responsible for all deficiency balances remaining on the loan per the terms of the original loan documents..."
MY CLIENT IS ANGRY

I do not know who is more stupid, the one who bought the bundle of notes secured by Real Estate without having the proper paperwork in their favor or the one selling the note without having the proper paperwork in their favor. With all this foreclosure nonsense, litigation, short selling, loan moding and all the rest of it.....one wonders what will become of the Real Estate industry. This is a fair question and cannot be answered in detail mainly because Real Estate is so vast and also because we are in the eye of the hurricane....

In several articles that just came out, the banks are halting the foreclosure processes because they found errors in their procedures....These errors are being brought to the surface via lawsuits filed by foreclosed upon homeowners who fought back
Let's not debate weather someone should be in foreclosure or not. Instead, I just wanted to mention how the 3 foot hole that the banks found themselves in has just turned into a 6 foot hole...of their own doing.

It looks like foreclosures will rule the day and that loan modifications are trailing away. Slowly, but reluctantly, the public is starting to come to grips with losing their homes and their monies and having to start all over again.
It is harder for some to accept, but in time as with everything else, adjustments will be made and life goes on.....as it is intended to do. Regardless of the cause, I am sorry for your loss...........

I ran into a former client who owns his home free and clear. It doesn't take more than $120.00 a month to pay for their insurance and taxes. The rest of their expenses depends on how they want to live.
I found it refreshing to meet someone who is NOT being thrown-out, who isn't underwater, in foreclosure, and who isn't in bondage to their mortgage.
I couldnt help but think how important it is to get your expenses down during these recessionary times. If things continue to get worse...then people who have their expenses to a minimum will fair much better. … (9 comments)
